In view of the letter from the Board of Trade
I recommend that the Governor in Council under sub-section
(2) of section 15 of Ordinance 26 of 1891, forthwith substitute
the new Board of Trade paragraph 11 (of the regulations) for
the local regulations pages 14,15 and 16 relating to sight
tests, The Harbour Master will then cease to endorse certifi-
cates, which I understand is very rarely done here.
With regard, however, to the course proposed to
be pursued by the Board of Trade under section 471 of the
(Imperial) Merchant Shipping Act of 1894, the wording of our
local Ordinances is somewhat different.Probably the best course
would be to add to sub-section (5) of section 19 of the Mer-
chant Shipping Consolidation Ordinance (No.36 of 1899), as soon
as it comes into force, a further sub-section (9) to the fol-
lowing effect.-
"When any master or mate holding a British
certificate of competency is reported as having failed in the
form vision, colour vision, or colour ignorance tests, and to
be, therefore, incompetent."
The Court could then act under sub-section (8)
B of section 19.
